There are three types of whistleblower protection laws:

• Qui Tam lawsuits are cases brought by private citizens on behalf of the federal government against contractors and others who fraudulently receive or use government funds. The right to file this type of lawsuit was established by the federal False Claims Act. If the action is successful the qui tam plaintiff is rewarded with a percentage of the recovery. The False Claims Act also protects whistleblowers from acts of retaliation such as termination, salary cuts and harassment.
• The Sarbanes-Oxley Act was passed to restore public confidence in publicly traded companies by establishing an accounting oversight board, auditor independence and improved financial disclosure. The act applies to both private entities as well as nonprofit health systems. The Sarbanes-Oxley Act contains provisions to reward and protect whistleblowers.
• In addition, each state has its own set of laws to protect employees who report cases of fraud and wrongful conduct against their employers. Many of these state laws also provide compensation for the whistleblowers.
